06/30/08 NEW RESET POLICY

Effective 6/30/08 cases will be disposed of within 150 days of the date filed. The first reset will continue to be 90 days off the arraignment docket, the second reset will be 30 days and the third reset will be 30 days. (150 days total). If the case is NOT disposed of by day 150 from the date filed, the case will be set for PRETRIAL. THIS INCLUDES EXISTING CASES!

RESETS BY PHONE

 

Phone calls to reset cases from arraignment docket on Wednesdays and plea docket on Thursdays will be permissible, however, pretrials will continue to need a DA's signature. Revocations will still need the Judge's signature.

General office Policy is to have all revocation cases disposed of within 90 days of filing.** All reset requests on Revocations must be presented to the Judge.

Reset forms will be e-mailed to attorneys. Our standard reset will continue to be printed in PDF format.

02/04/05 Jail Pleas
The thumbprint of the defendant is required for all defendants pleading via video at the jail.

Pleas of Guilty resulting in jail time, SPURS, work release or weekends: Secure Thumbprint on JUDGMENT PLEAS OF GUILTY resulting in probation: The Probation Department will secure prints PROBATION REVOCATIONS resulting in jail time, SPURS, work release or weekends: Secure thumbprint on SENTENCE (Fill in cause number and defendant’s name-and nothing more-on the sentence)

The JUDGMENT and SENTENCE must be turned in with the remainder of the plea papers. Jail personnel are prepared to do the printing when you go to the jail to get the plea papers signed by your client. Judgments and sentences without thumbprints cannot be filed. Attorney fee requisitions should be returned along with the properly thumbprinted judgments and/or sentences.
 
01/19/05 Work Release 
The application and order for work release has been revised. Please download your copy now. All copies dated January 14, 2003 should be destroyed. Work Release applications which are not fully completed at time of sentencing will not be considered at that time, but may be considered after sentencing and when fully completed. Multiple Offenses: If a defendant pleads to jail time in multiple offenses and desires to apply for a Work Release Order, please prepare the application and proposed order in the cause number with the longest sentence and include the cause numbers for all other cases below the first cause number. Present the case with the longest sentence to the court first and advise that you are applying for a Work Release Order in all cases to which the defendant is pleading guilty.

TRIAL POSITION

All trials on docket are expected to be ready Monday morning at 9:00 a.m. and the order will be determined by the court at that time. All cases should have subpoenas issued and ready to proceed on Monday morning.

RESETS NOT GRANTED

Resets will not be looked upon with favor when filed within 30 days of trial date. Motions for Continuance in compliance with the Code of Criminal Procedure will be considered, if filed and served on opposing counsel not later than seven (7) days before Announcement Docket.

ANNOUNCEMENT DOCKET

Announcement Docket will be held at 1:30 p.m. on Fridays immediately preceding trial date. Defense attorneys and defendants must be present unless waived by court approval. The Assistant District Attorney in charge of each case on the trial docket must attend the Announcement Docket.

 

ALL PLEAS TO BE COMPLETED AT THIS TIME. PLEAS WILL NOT BE TAKEN ON MONDAY TRIAL DATE!

TWO JURY PANELS AVAILABLE

A separate jury panel for Monday and Tuesday will be ordered for the trial docket. Case number one on the trial docket will pick a jury beginning at 10:00 a.m. on Monday. Case Number two will pick a jury at 9:00 a.m. Tuesday. In the event that case number one fails to go to trial, each will be called until all are resolved or one or more proceeds to trial.

ATTORNEYS RESPONSIBLE

Attorneys on the trial docket are responsible for keeping informed of their position on the docket.
